Jiangxi standardizes the Management of Mine Ecological Restoration Fund
Xinhua News Agency, Nanchang, 14 Nov (Reporter Guo Qiang) the Department of Natural Resources, the Department of Finance, and the Department of Ecological Environment of Jiangxi Province jointly formulated the "measures for the Administration of Jiangxi Province Mine Ecological Restoration Fund" a few days ago. We will standardize the planning, use, and supervision of mine ecological restoration funds, and urge mining enterprises to fulfill their obligations for mine environmental management and restoration and land reclamation.
According to the administrative measures, mining enterprises shall set up a comprehensive ecological restoration fund on the basis of the income, mineral type coefficient and mining coefficient of direct and indirect sale of raw ore every quarter. The scope of use of the fund includes expenditure on the prevention, treatment and restoration of geological and environmental problems in mines, such as ground subsidence, ground fissures, collapses, landslides, debris flows, etc., caused by mineral resources development activities. Expenditure on prevention and treatment of surface vegetation damage and topographic landscape damage, reclamation expenditure of damaged land, prevention and treatment of groundwater aquifer damage, etc.
Mining enterprises should repair at the same time of production, and apply for acceptance of ecological restoration in accordance with the first stage of three years; before stopping, closing or closing the pit, the fund shall be used to complete the ecological restoration of the mine and apply for acceptance in a timely manner, and the insufficient part shall be made up by the mining enterprise. Enterprises that fail to perform their obligations of ecological restoration in accordance with the requirements shall be ordered to rectify within a time limit, and if they fail to rectify within the time limit or are not in place within the time limit, they shall be included in the abnormal list of mining owners or on the list of serious violations of law and breach of trust. Enterprises that refuse to perform their obligations of restoration may designate qualified social organizations to file a public interest lawsuit with the people's court for their acts of destroying the ecological environment of mines, and punish them and investigate their legal responsibilities in accordance with relevant laws and regulations.
