A breeding company in Hubei province was fined more than 1.9 million yuan for infringing fertilizer in the lake.

Recently, the Wuhan Maritime Court sentenced the ecological public interest lawsuit in the Yangtze River economic belt, and the company was sentenced to more than 1.9 million yuan in compensation for water environmental damage, and made a public apology to the public.
It is understood that the public interest litigation prosecutor, the Wuhan Railway Transportation Branch of the Hubei Provincial people's Procuratorate, believes that the defendant Yangxin Netlake Ecological breeding Co., Ltd., during the fishing and aquaculture period of the Great Lake from 2014 to 2016, In violation of the relevant regulations and contractual agreements, phosphorus-containing fertilizers shall be put into the Great Lake of the net Lake. Of these, about 1000 tons of phosphate fertilizer, 2000 tons of nitrogen fertilizer and 1000 tons of organic fertilizer were injected in 2014, and about 46000 tons of feed such as soybean dregs and brewer's grains were injected in 2015 and 2016. The results showed that the total phosphorus in the entrance of the net lake, the center of the net lake and the exit of the net lake exceeded the standard and showed a state of eutrophication. The defendant's behavior violated the relevant provisions of the Environmental Protection Law and the Water pollution Prevention Law, and damaged the social and public interests. The Wuhan Railway Transportation Branch filed this environmental public interest lawsuit as the prosecutor of the public interest litigation appointed by the Hubei Provincial people's Procuratorate.
After trial, the Wuhan Maritime Court found out that when the contract was signed, it was agreed that the defendant must adhere to the standard of ecological aquaculture so that the water quality of the whole lake could reach the class III water standard. During the aquaculture period, the defendant threw phosphorus-containing fertilizer into the Great Lake, resulting in water pollution. The court held that the Wanghu Wetland Nature Reserve, where the pollution occurred in this case, is located in the southeast of Yangxin County, Hubei Province, and is closely related to the ecological environment of the Yangtze River. The defendant's act of putting phosphorus-containing fertilizer into the water body of the net lake violates the law and pollutes the water body of the net lake, and then causes damage to the ecological environment of the Yangtze River, so he should bear the tort liability.
After collegial discussion, the court ruled on the spot that the defendant compensated 1946776 yuan for environmental damage to the water body of the Great Lake, which was used for the overall treatment and restoration of the water body of the Great Lake, and made a public apology to the public in the local news media at or above the municipal level in Huangshi City.
